Terms and Conditions for Astrology Reports
It's In The Stars Pty Ltd


1.Purchase & Confirmation of Order
1.1By clicking “Submit” on the Order Form You agree to purchase the Report from It’s In The Stars for the Purchase Price. Subject to these terms and conditions, upon receipt of the duly completed Order Form, It’s In The Stars will notify You if its acceptance of Your order by sending an email to Your email address specified in the Order Form.
1.2If Your order is not accepted by It’s In The Stars, You will not be charged the Purchase Price or if applicable, the Purchase Price will be refunded to You.

2Delivery
2.1 It’s In The Stars will endeavour to ensure the Report is delivered to the Delivery Address within 5-7 days of the Order being received, unless otherwise agreed by You and It’s In The Stars. Please contact It’s In The Stars If the Report is not received by the Recipient within 14 days of notification of It’s In The Stars’ acceptance of Your order.

3Payment
3.1 Your Order will not be accepted until payment has been received.

4Use of the Report & Reliance on Information
4.1 As astrology is not an absolute science and is subject to individual interpretation, this Report is provided to the Recipient and must only be used by the Recipient, for entertainment, educational and recreational purposes.
4.2 It’s In The Stars makes no representations and gives no warranties regarding the accuracy or significance of any aspect of the astrological horoscope and its application to the information provided by You and It’s In The Stars accepts no responsibility for any use or interpretation of the Report or any part of the Report by You, the Recipient or by any third party.
4.3 The Report is not intended to be a substitute for intelligent and informed decision making, nor is the Report intended to be a substitute for the advice of a doctor, therapist, psychiatrist, psychoanalyst, psychologist, counselor, financial planner, lawyer, minister of religion or other professional.
4.4 The information in the Report is not intended to treat, diagnose, or cure any ailments, diseases or injuries and It’s In The Stars provides no guarantees that the Report will affect or improve financial position, career direction, employment matters, lifestyle, love-life, family status, relationships or any other matter.

5Disclaimer & Liability
5.1 To the extent permitted by law, It’s In The Stars provides the Report without any guarantee or warranty of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, reliability, usefulness, use or results to be obtained from the report or any of the information in the Report.
5.2 It’s In The Stars will not be liable to You, the Recipient, or any third party, and You indemnify It’s In The Stars against any and all claims (including but not limited to claims from the Recipient and third party claims), actions, demands, proceedings, losses, costs (including but not limited to legal costs), expenses, penalties and liabilities incurred, suffered or brought against It’s In The Stars arising from Your breach of these terms and conditions (including warranties) or Your, the Recipient’s, or any third party’s use of and/or reliance on the Report, any part of the Report or any information, techniques, ideas, predictions and/or advice forming part of the Report.

6Intellectual Property
6.1.You acknowledge and agree that It’s In The Stars owns all intellectual property rights (including copyright) in the Report.
6.2Subject to the provisions of the Copyright Act 1968 (Cth), You must not, and must not allow any third party to, reproduce, create a derivative work of, adapt or modify the Report or any part of the Report without the prior written consent of It’s In The Stars.

7Warranties
7.1You warrant to It’s In The Stars that all information provided by You is true and correct.

8General
8.1These terms and conditions are governed by the laws of New South Wales, Australia.
8.2These terms and conditions constitute the entire understanding of the parties, the entire terms agreed between the parties, and supersede any prior written or verbal communications or other agreements between the parties.
8.3If any part of these terms and conditions is deemed to be illegal, void or unenforceable, that part of these terms and conditions will be severed to the extent of that illegality, voidness or unenforceability, without invalidating the remaining provisions.

9Definitions & Interpretations
9.1In these terms and conditions, unless the context otherwise requires:

Delivery Address means the Delivery Address specified in the Order Form;

It’s In The Stars means It’s In The Stars Pty Ltd (ACN 092 825 815) of PO Box 585, Leichhardt, NSW 2040;

Order Form means the order form completed and submitted by You for Your purchase of the Report;

Purchase Price means the purchase price for the Report specified in the Order Form;

Recipient means the person (or persons) for whom the Report is prepared for and delivered to, as specified in the Order Form;

Report means the astrology report specified in the Order Form; and

You or Your means the person specified in the Order Form as ordering a Report from It’s In The Stars.

9.2The Order Form forms part of these terms and conditions. If there is any inconsistency between the Order Form and these terms and conditions, these terms and conditions will prevail to the extent of the inconsistency.
